There’s a lot of confusion that surrounds the Spill Prevention, Control and Countermeasure (SPCC) Rule enacted by the United States Environmental Protection Agency, and the result for some businesses can be non-compliance and costly fines.

A lot of our clients have questions about SPCC, so we’ve compiled answers to some of the most-asked questions we receive regularly when it comes to compliance.

Who is required by law to have an SPCC plan in place?

Any business that has oil-filled equipment with an aggregate aboveground storage capacity of 1,320 gallons of oil or more per location requires an SPCC plan. This includes equipment like transformers, regardless of whether the equipment is full or nearly empty.

What are the fines for non-compliance with SPCC?

Fines can start at $1,000 for not having an SPCC plan in place, not including the possible fines you could face from 68 other categories. Fines are normally assessed in proportion to the size of the facility — the bigger your facility, the bigger the fine you could face.

What is considered “oil”?

In regards to SPCC regulation, “oil” relates to oil in any form, including:

  • Crude oil
  • Refined petroleum products (gasoline & diesel fuel)
  • Sludge
  • Waste oil
  • Oil emulsions
  • Lube oils
  • Grease
  • Fats, oils or greases from animal, fish, or marine mammal origin
  • Vegetable oils, including oils from seeds, nuts, fruits, or kernels
  • Other oils and greases, including synthetic oils and mineral oils

Is a secondary containment solution necessary for my oil-filled equipment?

Absolutely! The secondary containment must hold the contents of the largest container plus freeboard for precipitation if outdoors. Double-walled storage tanks do not need additional containment.
